Rather than delaying the closing, the buyer purchases the home as scheduled and then leases the property back to the seller for an agreed period under the terms negotiated in the contract.

In many transactions, the leaseback lasts only a couple of days. Those extra days simply provide the seller with enough time to move into their next home without the stress of moving everything immediately after closing. In other situations, however, a seller may request a longer leaseback period. Every transaction is unique, which is why I carefully discuss the advantages, responsibilities, and potential risks with my clients before agreeing to any leaseback arrangement.

When financing is involved, buyers should also understand an important lender requirement. Most owner occupied mortgage programs require the buyer to occupy the home within 60 days after closing. Because of that requirement, a Seller Leaseback generally cannot extend beyond the fifty ninth day after closing if the buyer intends to satisfy their lender's occupancy requirement. Planning ahead helps ensure the negotiated leaseback works for both parties while remaining consistent with the buyer's loan obligations.
